Presenting for applicant Engineer Rachel Barese and Expeditor Kalman Herskovits H. Ross read the legal notice. Affidavits of posting and mailing have been received on this application.

The site is currently developed with a single-family residence. The applicant proposes to convert the existing dwelling into a school serving up to 80 students. The ages of the students will be 13-16 years old. 10 parking spaces are required and 10 are being provided. There will be three minibuses servicing the property. Attorney Richard Mahon (for opposing neighbors): Mr.

Mahon stated he does not believe SEQRA has been satisfied. He stated he did not see a traffic study, hydrant flow test, fire sign off etc. He stated the ownership affidavits do not match the owners stated on the building permits. Many members of the public spoke both for and against the application. The main concerns that were mentioned were the following: • Character of neighborhood changing.

• Kids from the Yeshiva using the neighbor at 32 Concords house as a cut through. • School has been operating for over a year and they are using regular size buses not mini buses. • Traffic concerns.

SEQRA RESOLUTION SEQRA NEGATIVE DECLARATION – Unlisted Action WHEREAS, The Ramapo Planning Board has received an application from Bartlett Yeshiva LLC (applicant) for a Site Development Permit and Special Use Permit at 5 Bartlett Road, Monsey. The project site consists of a 1.

59-acre parcel located at 5 Bartlett Road, identified on the Tax Map as Section 49.11, Block 1, Lot 39. The site is currently developed with a single-family residence. The applicant proposes to convert the existing dwelling into a school serving up to 80 students. The site will provide 10 off-street parking spaces accessed via the existing curb cut on Bartlett Road.

Two new curb cuts are proposed along Sickle Lane to accommodate bus drop-off and pick-up. The site will be served by municipal water and sanitary sewer. The property is located within the R-40 Zoning District, and the proposed use requires approval of both a Site Development Permit and a Special Use Permit.

WHEREAS, Article IX of the Code of the Town of Ramapo provides the Planning Board with the authority to approve site development permit applications; and, WHEREAS, The Planning Board has received a Short Environmental Assessment Form (“SEAF”) for the project dated December 18, 2025, with Part I completed by the applicant.

The Town of Ramapo Planning Board determined this application to be an Unlisted Action pursuant to Part 617 of Environmental Conservation Law (ECL). The Town of Ramapo Planning Board requested SEQR Lead Agency status and underwent a coordinated review that was initiated on June 12, 2026.

No other involved agency indicated their desire to seek lead agency status, and; WHEREAS, The Town of Ramapo Planning Board, as the SEQR Lead Agency has reviewed Part II and III of the SEAF, prepared by the Board’s consulting engineer, which identifies potential project impacts, and the SEQRA criteria of significance set forth in 6 NYCRR 617.

7(c), and; WHEREAS, The Town of Ramapo Planning Board, in its review of Parts II and III of the SEAF, has considered that the project impacts that may occur will be minimal in nature and do not exceed the SEQRA criteria of significance, and; NOW THEREFORE, BE IT RESOLVED, That the Town of Ramapo Planning Board hereby determines that the information submitted by the applicant is adequate for determining the significance of the proposed action; and, BE IT FURTHER RESOLVED, That based upon its review of the project and the SEAF, review of the application by the Town’s professional staff, including, chief zoning officer, town attorney, and town engineer, and comparison with the criteria for determining significance found at 6 NYCRR Section 617.

The applicant is proposing to expand an existing school at 145 Saddle River Road. Applicant is putting in a left turn lane on Saddle River Road. No issues with CDRC report. Override comments# 1, 2, 3, & 11 of the GML letter. Board Comments: • Do not open wedding hall until parking is complete. • Relocate the garbage enclosure. • Fence in garbage enclosure. • Add 14 benches to the park area.

The development area consists of +/- 10.02 acres on the east side of Saddle River Road, approximately 225 feet north of Old Nyack Turnpike. The applicant is proposing to expand an existing school at 175 Saddle River Road. The site currently has two, 2-story brick buildings and modular buildings serving its campus as well as a 38-space parking area and inground swimming pool.

The existing school serves 1,205 students Monday through Thursday, 60 students on Friday and 600 students on Sunday. As part of the 4 Phase expansion, the southern 2-story brick building and modulars will be demolished, 3 new buildings and additional parking will be constructed.

Two new buildings, 22,024 SF and 24,304 SF in size, will provide space for classrooms, offices, multi-purpose space and storage and the third building will be a new gymnasium. The future student population will be 1,600 students Monday through Thursday, 800 students on Friday and 800 students on Sunday.

This represents an increase of 350 students Monday through Friday, 200 students on Friday and 200 students on Sunday. A total of 255 parking spaces are proposed at full build out. The parcel is located in the Town’s R-15A Zoning District and requires a Site Development Permit and Special Use Permit approval.

WHEREAS, Article XI of the Code of the Town of Ramapo provides the Planning Board with the authority to approve Special Use Permit applications; and, WHEREAS, The Planning Board classified the application as a Type I SEQR Action pursuant to Part 617 of Environmental Conservation Law (ECL) and initiated a coordinated review at their regularly scheduled meeting of December 5, 2025.

WHEREAS, The Planning Board issued a Negative Declaration under SEQR at their regularly scheduled meeting of February 2, 2026; and, WHEREAS, The applicant applied for and was granted area variances from the Ramapo Zoning Board of Appeals on January 19, 2026, as case number ZBA 26-359; and, WHEREAS, The application was referred to the Rockland County Planning Department on July 28, 2026; and, WHEREAS, The Planning Board conducted a public hearing at their regularly scheduled meeting on August 25, 2026 to consider the application for Special Use Permit approval, and, WHEREAS, At their regularly scheduled meeting of August 25, 2026, the Planning Board overrode by a supermajority vote the Rockland County Department’s specific comments 1, 2, 3, & 11 of the aforementioned Rockland County Planning Department letter dated August 13, 2026; and, WHEREAS, The applicant has been before the CDRC on June 5, 2024, through, June 3, 2026, at which times professional staff reviewed comments provided on the application; and, WHEREAS, The Planning Board has carefully reviewed the proposal, considered public comments received as well as comments received from the CDRC, and by this resolution does set forth its decision hereon, Town of Ramapo August 26, 2026 Meeting Minutes 1.

That the proposed use is of such location, size, and character that it will be in harmony with the appropriate and orderly development of the district in which it is proposed to be situated and not be detrimental to the site or adjacent properties in accordance with the zoning classification of such properties. 2.

That the location and size of such use, the nature and intensity of operations involved in or conducted in connection therewith, its site layout, and its relation to access streets is such that both pedestrian and vehicular traffic to and from the use and the assembly of persons in connection therewith will not be hazardous. 3.

That the location and height of buildings, the location, nature, and height of walls and fences, and the nature and extent of the landscaping on the site are such that the use will not hinder or discourage the development and use of adjacent land and buildings. 4.

That the proposed use does not require such additional public facilities or services or create such fiscal burdens upon the Town greater than those which characterize uses permitted by right. NOW THEREFORE, BE IT RESOLVED, The Planning Board hereby grants Special Use Permit approval for application 2024.012: Bais Rochel Special Use Permit at 15 Saddle River Road, Airmont with tax lot ID: 56.16-2-14.

The project site consists of a 5.41-acres on two existing parcels located at 214-228 Old Nyack Turnpike & 230-236 Old Nyack Turnpike, identified as Tax Map Nos. 57.17-4-58.1 & 58.2. The site is currently occupied by existing residential occupied townhouses. The applicant proposes a lot line adjustment to resolve existing encroachment where certain improvements are located on the western parcel. Approximately 0.

1 acres of land will be affected by the lot line adjustment, being transferred from lot 58.2 to lot 58.1. There is no construction or land development proposed with this application. The project is located within the MR-8 zoning district and will require Amended Subdivision Permit approval.

WHEREAS, Article IX of the Code of the Town of Ramapo provides the Planning Board with the authority to approve Subdivision Permit applications; and, WHEREAS, The Planning Board classified the application as a Type II SEQR Action pursuant to Part 617 of Environmental Conservation Law (ECL) and concluded the environmental review of this application at their regularly scheduled meeting of January 9, 2026.

WHEREAS, The Planning Board conducted a public hearing at their regularly scheduled meeting on August 25, 2026, to consider the application for Subdivision Permit approval; and, WHEREAS, The application was referred to the Rockland County Planning Department on July 23, 2026, and comments were received in the letter dated August 12, 2026, and the Applicant is not seeking any GML overrides; and, WHEREAS, The applicant has been before the CDRC on July 22, 2026, at which time professional staff reviewed comments provided on the application; WHEREAS, The applicant has substantially addressed CDRC comments, with remaining comments to be addressed as a condition of any action taken on the application; and, Town of Ramapo Planning Board August 26, 2026 Meeting Minutes WHEREAS, The Planning Board has carefully reviewed the proposal, considered public comments received as well as comments received from the CDRC, and by this resolution does set forth its decision hereon; NOW THEREFORE, BE IT RESOLVED, The Planning Board hereby grants Amended Subdivision Permit approval for application 2026.
